TERMS & CONDITIONS
The purpose of this Retreat Agreement is to communicate our mutual expectations during this Dreamporting Retreat/Event. Please raise any questions you have before signing to make sure we are on the same page moving forward.

In exchange for joining us at this magical event, you agree to the following terms:



1. Parties
This Agreement is made between Dreamporting LLC, a Limited Liability Company operating in the State of Texas (“Dreamporting, “we”, “us”, and “our”) and you, the undersigned (electronically or by hand) or person who has clicked “I Agree” to this Agreement (“you” and “your”).




2. Payment & Deposit
In order to reserve your spot on a retreat, a 20% deposit is required if you are not able or willing to begin a payment plan or pay in full. This deposit is non-refundable. In the event that Dreamporting cancels the retreat, your deposit will be credited towards another Dreamporting event, valid for three years.



3. Refunds & Cancellations
Our refund policy is as follows:
If you cancel your spot 60 days before the retreat, you will receive a full refund. If a guest cancels less than 60 days prior to the retreat there is no refund. However, your deposit will be applied towards another Dreamporting event. If a guest leaves during the retreat, there will be no refund. We highly recommend purchasing travel insurance at the time of your booking so you are protected in the event you need to cancel with less than 60 days notice.




3.1 Weather, War and Unforeseen Events
In the event of cancellation or changes due to current or imminent weather, war, natural disaster, or pandemic, participants will receive a 50% refund of the retreat, and 50% credit towards any Dreamporting offerings of their choice such as another retreat, private sessions or courses.


3.2 Cancellation & Refunds
Dreamporting reserves the right to cancel any retreat or part of the retreat. In this event we will provide retreat credit, which will be valid for three years. If Dreamporting cancels a retreat for any reason, Dreamporting is not responsible for loss of funds in association with travel accommodations made by the guest.


4. Infectious Disease Liability Waiver Release
The World Health Organization has declared the novel Coronavirus (“COVID-19”) a worldwide pandemic. Due to COVID-19’s capacity to transmit from person-to-person through respiratory droplets, and possibly through airborne transmission, the government has set recommendations, guidelines, and some prohibitions which Dreamporting LLC (the "Company") uses all reasonable efforts to comply with and satisfy.
In consideration of being allowed to participate in an event, symposium, coaching session, training, or any type of educational or personal improvement program offered by the Company (“Company Event”), the undersigned acknowledges, agrees, and confirms all of the following:
I am aware that my physical presence and participation in any Company Event may risk my serious injury, illness, or death caused by COVID-19, a mutated virus therefrom, or other contagious disease. I understand the Company cannot prevent me from becoming exposed to or contracting COVID-19 or other contagious disease while attending an event in person, and it is not possible to totally prevent against the presence and transmission of any disease

I am aware that symptoms of COVID-19 include fever, fatigue, difficulty in breathing, persistent dry cough, sore throat, muscle aches and pains, diarrhea, loss of smell and/or taste, and chills. I have not exhibited any of those symptoms or any other symptoms relating to COVID-19 within the last 14 days, including on the date I sign this document.

I have not, nor has any member of my household, been diagnosed to be infected with COVID-19 or any other communicable disease within the last 30 days.

I have not, nor has any member of my household, traveled by sea or by air internationally within the past 30 days, including cruise ships which might both embark and disembark at U.S. ports.

I did not, nor did any member of my household, visit within the last 30 days any area of the United States that was reported by the CDC to be highly affected by COVID-19.
Understanding and confirming the pronouncements above, I hereby agree as follows:
I am fully and personally responsible for my own health, safety, and actions during my participation in any Company Event and I recognize that I am at risk of contracting a serious injury, illness, or even death caused by COVID-19, a mutated virus therefrom, or other contagious disease.

During my participation in any Company Event, I am personally responsible at all times to wear a face mask over my mouth and nose, maintain at least 6 feet of social distancing from others, wash my hands as frequently as possible, and follow other precautions and guidelines established by the CDC and/or the Company for the prevention of spreading and contracting COVID-19 or other infectious disease.

I agree not to participate in person at any Company Event if, on the day(s) of such event, I have any symptoms of COVID-19, including fever, fatigue, difficulty in breathing, persistent dry cough, sore throat, muscle aches and pains, diarrhea, loss of smell and/or taste, and chills.

With full knowledge of all the above and the risks involved, I, for myself and on behalf of my spouse, domestic partner, my estate, and my heirs, hereby release, waive, discharge, and hold harmless the Company, and all its board, officers, employees, independent contractors, representatives, successors, and assigns (“Released Parties”) from any all liabilities, claims, demands, and causes of action whatsoever arising, directly or indirectly, out of or relating to any injury, loss, damage, or death that may be sustained by me related to catching or contracting COVID-19, a mutated virus therefrom, or other contagious disease while participating in any Company Event, excluding however, any injury caused by the gross negligent or willful acts of the Company.
By agreeing to these terms and conditions I acknowledge that: I have read the entirety of this document and understand its contents; I have been sufficiently informed of the risks involved in attending any Company Event; and I give my voluntary consent and agreement in signing this document as my own free act and deed with the full intention to be bound by all terms of this document.
This document may be executed electronically and is deemed to be executed in Austin, TX. This document shall be governed by and construed under the internal laws of the State of Texas without regard to any conflict-of-laws rules or principles. Any controversy or claim arising out of, or relating to, this document shall be subject to jurisdiction in Austin, TX.






5. Passports, Visas, and Flights
You are responsible for obtaining all required travel documents for countries you will visit during the retreat. For many countries, passports must be valid for at least 6 months beyond the duration of the trip. Visa information will vary location to location, and details will be included in your trip’s logistics. You are responsible for booking flights to the retreat. We can help find options, but cannot book or cover costs for flights. We are not responsible if you are refused entry into the country because of incorrect travel documents and this event will not result in a refund.




6. Ownership of Materials
All content that we have provided to you, including but not limited to videos, documents and PDFs, are for your use only and are not to be re-distributed or re-used.



7. Media Release
You understand that Dreamporting may use photos, audio or video of you as a means to document, share and promote Dreamporting Retreats and the Retreat. By attending this event you are giving Dreamporting your permission to capture your likeness in photo, audio or video format and waive the right for compensation. Please know any such sharing will be used for marketing and promotional purposes only.


8. Recommended Travel Insurance
We recommend you obtain “cancel anytime” travel insurance that covers your participation in the activities on the Retreat. Each client is 100% responsible for any loss, penalties, fees, or other financial consequences arising out of booking a trip or the cancellation of a trip.



9. Requests for a Roommate
If you are traveling alone, and would like to book a shared room, we will do our best to room you with another guest. If we are unable to fill the room, you may need to upgrade to a private room. If this is the case, we will give you as much notice as possible.



10. Discretion to Deny Bookings
We reserve the right to reject any client booking at any time prior to the start date. If we reject your booking for any reason, you will be offered a full refund for the retreat. If at any point you are found being disrespectful or inappropriate toward a Dreamporting Team member or another retreat/event participant, Dreamporting reserves the right to remove you from the retreat. In this event, no refund will be permitted.






11. Health and Travel Warnings
Each guest assumes full responsibility for researching the safety and security of countries that will be visited. By booking a trip with Dreamporting LLC, you confirm that you are in good health and capable of performing the activities on the trip you booked. You are also confirming that you are able to care for yourself during the trip and do not have any medical conditions that could cause risk for yourself or others during the trip. You are confirming that you understand that Dreamporting Retreats may include the use of loud music or frequencies, flashing lights or light shows and that this may affect certain medical conditions such as the need for hearing aids.



12. Privacy Policy
Any personal information that we collect about you may be used for any purpose associated with the operation of a trip, or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the trip.



13. General Indemnity
You hereby fully indemnify Dreamporting and any of its members, directors, officers, employees, contractors, volunteers, agents, executors, administrators, successors, family members and assigns (the “Indemnified Parties”) and save harmless the Indemnified Parties from any losses, claims, damages, actions, causes of action, costs and expenses that an Indemnified Party may sustain, incur or suffer at any time, either during or after the Term, which are based upon, arise out of or occur, directly or indirectly, by reason of any act or omission by you in participating in the Retreat, provided that where Dreamporting has contributed to such liability by its own negligent conduct, your indemnity obligation will be limited proportionately.



14. Standard Legal Things. Choice of Laws and Venue
This Agreement will be governed exclusively by the laws of the State of Texas. The parties agree to irrevocably submit all claims to the exclusive jurisdiction of the courts of the State of Texas. Severability. If any provisions of this Agreement are invalid or unenforceable, the other provisions in the Agreement will remain in full force and effect. Entire Agreement. This Agreement constitutes the entire Agreement between the parties and replaces any prior agreements. Waiver of Breach. The waiver by me of any breach by you of any provision of this Agreement will not be taken to be a waiver of any further breaches by you. Notice. For the purpose of this Agreement, e-mail or text will suffice for written notice when required as set out above. Headings. The headings used in this Agreement are for stylistic purposes only and none of the content in the headings are intended to be legally binding. Counterparts. This agreement may be signed by any number of counterparts, each of which is an original, and all of which taken together constitute one single document. Online Agreement. We agree that this Agreement may be signed electronically or agreed to by having you click “I Agree”, the effect of which will be the same as if we signed the Agreement by hand and the intention of which is that both parties desire to be bound by all the terms of the Agreement.
